Terms of Service

These terms are the agreement between you and us when you play Farwake on iPhone or Android. By playing, you accept them. Please also read our Privacy Policy.

1. Who provides Farwake

Farwake is provided by KD Incubator UG (haftungsbeschränkt), Schönensche Str. 13, 10439 Berlin, Germany (“we”, “us”). Contact: office@kdincubator.com.

2. Who may play

You must be at least 13 years old to play Farwake. In countries of the EEA where local law sets a higher age for consenting to online services (up to 16, for example in Germany), you need a parent’s or guardian’s consent if you are below that age. If you are under the age of majority where you live, a parent or guardian should read these terms with you and agree to them on your behalf.

3. Your account and progress

• When you first open Farwake, a game account is created for you automatically. Your progress, gems and purchases are tied to it.
• You can link the account to Sign in with Apple or Sign in with Google. Signing in lets you restore your game on a new device.
• If you don’t sign in, deleting the app, resetting or losing your device can mean losing your progress and purchases for good. We can’t recover an account that was never signed in.
• Keep your Apple or Google account secure. You are responsible for activity on your game account.

4. Gems and virtual items

• Gems, passes, unlocks and other in-game items are a limited, personal, non-transferable and revocable licence to use them in Farwake. You don’t own them.
• They have no cash value. They can’t be exchanged for money, sold, traded or transferred to another account.
• They are not refundable, except where the law or the store’s refund policy requires it.
• Purchases are made through the Apple App Store or Google Play and are handled and refunded under Apple’s and Google’s rules. To ask for a refund, contact the store you bought from.
• If a refund is granted, we may remove the items it covered from your account.

5. Passes and one-time purchases

• 30-day commander pass: this is not an auto-renewing subscription. It runs for 30 days from purchase and then ends. You are only charged again if you buy it again.
• One-time purchases: ad-free rewards, faction unlocks and the starter kit are bought once.
• Gems, passes and one-time purchases belong to your account, not to one faction. They apply to every faction you play on the account.
• Purchases can be restored on the same App Store or Google Play account they were bought with, by signing in to Farwake the same way on your new device.
• Prices are shown in the store before you confirm a purchase and include any taxes the store collects.

6. Rewarded ads

Watching ads is always optional. Rewarded ads have daily limits. A reward is granted only after the ad network confirms to our server that the ad was watched, so a reward can be missing if the ad didn’t finish or the confirmation failed.

7. Fair play

Play Farwake as it is meant to be played. You must not:

• cheat, use modified or unofficial versions of the game, or edit save files;
• exploit bugs, or use bots, scripts, macros or other automation;
• interfere with our servers, purchases or ad rewards, or try to get items you didn’t earn or pay for.

Uploaded saves are checked automatically. If we detect tampering, we may roll your game back to an earlier save, remove items obtained unfairly, and suspend or close the account. Where possible, we will tell you why.

8. Changes to the game

Farwake is a live game. We may update, rebalance, change or remove features and content, or end the game. Where possible, we will give reasonable notice in the game before ending the game or removing features you paid for. Your statutory rights are not affected.

9. Intellectual property

Farwake, including its code, art, text, music, names and logos, belongs to us or our licensors. We give you a personal, non-exclusive, non-transferable and revocable licence to download and play the game on devices you own or control, for your own non-commercial use. You may not copy, modify, distribute, sell or reverse-engineer the game, except where the law allows it.

10. Ending these terms

You can stop playing at any time and ask us to delete your account (see Delete your Farwake account). We may suspend or close your account if you seriously or repeatedly break these terms. When the account is closed, your licence to its virtual items ends.

11. Disclaimers

We work to keep Farwake running and fun, but we provide it “as is” and “as available”. To the extent the law allows, we don’t promise that it will always be available, uninterrupted or free of errors, or that saves can never be lost. Nothing in these terms limits warranties or rights that you have by law and that can’t be excluded.

12. Limitation of liability

We are fully liable for damage caused intentionally or by gross negligence, for injury to life, body or health, and where liability is mandatory by law, such as under the German Product Liability Act.

For slight negligence, we are liable only if we breach an essential obligation, meaning one that makes the proper provision of the game possible in the first place and that you may regularly rely on. In that case our liability is limited to the damage that was typical and foreseeable when you accepted these terms.

Otherwise, and to the extent the law allows, we are not liable for indirect or consequential loss, or for lost virtual items or progress.

13. Governing law

These terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer in the EU or another country with mandatory consumer-protection laws, you keep the protection of the mandatory laws of the country where you live, and you may bring claims in the courts there.

14. Apple and Google

These terms are between you and us, not Apple or Google. If you downloaded Farwake from the Apple App Store:

• we, not Apple, are responsible for the game and its content, maintenance and support, and for handling any claims about it;
• Apple has no obligation to provide maintenance or support for the game;
• if the game fails to meet an applicable warranty, you may notify Apple, and Apple may refund the purchase price of the app (if any). Apple has no other warranty obligation for the game;
• Apple is not responsible for claims relating to the game, including product liability, legal or regulatory compliance, or consumer-protection claims, or for any third-party claim that the game infringes intellectual property rights;
• you confirm that you are not located in a country subject to a US government embargo and are not on a US government list of prohibited or restricted parties;
• Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

Your use of the stores is also subject to Apple’s and Google’s own terms.
